Recovering debt in Nigeria has become very easy, in fact you don’t need a lawyer, it is easy, efficient and not expensive but here is what you need to know.
This procedure will only work for debt of 5 million naira and below only.
It must be a civil matter, not criminal
It must be a debt case, somebody must be you and a promise to give you money.
There is a special court that is used to recover debt, it’s the Small Claims Court, so this is what you must do.
Go to the Magistrate Court in your state where the defendant lives or does business.
Request the Small Claims Form (Form 1 – Complaint Form) from the registry.
You will be given forms to fill about the debt, the nature and how much, just fill the forms.
Pay the required filing fee (usually it’s small money).
The debtor will be served a demand notice by the court to pay within 7-14 days. If he/she refuses to pay then the court will call both parties to know what really happened. If the debtor refuses to pay then the court will order him/her to pay. The whole case cannot last above 60 days
